Abstract

The objective of this research is to present an overview of deaths in prison custody from a triangulation in Brazil: analysis of judgments that judged claims for compensation from families of detainees who died inside the prisons of Amazonas, Ceará and Rio Grande southern. From a documentary research, we sought to analyze how many deaths and what causes occurred in the three states between 2016 and 2019, as well as, what are the reasons that led the Courts of Justice to decide on the (un)feasibility of compensation processes. The analyzed decisions reveal that there is no regional difference in relation to the arguments, but rather narratives linked to the categories of deaths. With the analyses, it was found that the arguments used in the three Brazilian states, in addition to showing a discourse impregnated with subjectivity and beliefs, which directly impacts the decisions of the judges, emphasizes a society that does not respect human dignity, making it compatible with the function of women. prisons that let/make death.
